I hate to say it, but I have to take Activision's side on this one. As much as I hate some of the moves the company has made this year, there's no doubting there was intent by AM General when they decided to focus in on a highly profitable company like Activision, instead of going after pretty much anyone they wanted to. AM General is barely above acting like a patent troll in this case. The words they use for this lawsuit could fit anyone or any company that has ever used a Humvee in anything, that would include Disney, but due to the fact it would be harder to sue Disney, and that very few, if any companies are worth as much as Activision who have used Humvee's or similar looking vehicles in their games, the intent is clear. Sure, they may have actually produced the product they patented, unlike a lot of patent trolls, but some of the claims they are making such as how Activision has "taken advantage of their kindness", or that Humvee's were "a key selling feature of the games" is total BS. The damages they are seeking are also far above what makes sense. Compensation, punitive and triple damages are simply too much and seem desperate. This is a lawsuit, that were it to go through, could cause more problems for the industry, as Activision would be looking to quickly recuperate losses incurred by the lawsuit, and if this actually goes to court, they may be doing that anyway, by how else, taking advantage of those who have purchased their games. All in all, this is a loss for the industry that may be felt all the way down to the line of consumers, and it's all for the intent of openingly showing greed to all who become aware of this frivolous lawsuit.
